These Terms & Conditions (“Terms”) govern your use of freightrestackingrework.com (the “Site”) and your requests for services from Freight Restacking Rework (“we”, “us”). By using the Site or sending us a request, you agree to these Terms. If you do not agree, please do not use the Site.
1. Our Services
We provide freight restacking, pallet rework, transloading, crossdocking, short-term storage and related services in Southern California. Information on the Site describes our services in general terms and may change without notice. It is not an offer that can be accepted.
2. Requests, Quotes and Work Orders
- Sending a form, calling or emailing us is a request for service, not a contract. We may accept or decline any request.
- We quote work before it starts. The price, scope and any conditions in the quote or work order you approve govern that job and take priority over these Terms where they differ.
- Quotes are based on the information you give us. If the load, location or conditions turn out to be different, we may revise the quote, and we will ask for your approval before doing extra work.
3. Response Times
We dispatch 24/7. Any response or arrival time we mention, including our average response time in Fontana, is an estimate, not a guarantee. Traffic, weather, site access, safety and crew availability can affect timing.
4. Your Responsibilities
- Give us accurate, complete information about the trailer, load and location.
- Make sure you have the authority to request work on the freight, trailer and site, and that we have safe, lawful access.
- Tell us about hazardous, fragile, temperature-sensitive or high-value goods before we start.
- Pay for approved work according to the agreed terms.
5. Photos and Condition Reports
We may photograph loads before and after our work to document condition. We provide these reports to you for your records and keep copies for ours. We will not publish photos that identify your company or goods without your permission.
6. Acceptable Use of the Site
You agree not to misuse the Site, including by submitting false or misleading requests, sending spam or malicious code, trying to gain unauthorized access, scraping it in a way that harms its operation, or using it for any unlawful purpose.
7. Intellectual Property
The Site’s content, including text, photos, graphics and logos, belongs to us or our licensors and is protected by law. You may view and print pages for your own business use. You may not copy, republish or use our content commercially without our written permission.
8. Third-Party Links and Services
The Site may link to or include services from third parties, such as Google Maps. We are not responsible for their content, availability or practices.
9. Disclaimers
The Site and its content are provided “as is” and “as available”. Articles and guides on the Site are general information, not legal, regulatory or professional advice for your situation; for example, they do not replace official DOT or FMCSA guidance. To the fullest extent permitted by law, we disclaim all warranties about the Site, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Site. Our responsibility for services we perform is set out in the quote or work order for that job and by applicable law. Nothing in these Terms limits liability that cannot be limited by law.
11. Indemnity
You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your breach of these Terms, or inaccurate information you gave us, to the extent permitted by law.
12. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in San Bernardino County, California, unless the law requires otherwise.
13. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed. Using the Site after changes are posted means you accept them.
14. Privacy
Our Privacy Policy explains how we handle personal information.
